Driving under the influence
Recently a 30-year-old man prepared to plead guilty to driving with cannabis present in his saliva.
The truck driver was intercepted on the Cunningham highway at Willowvale.
He said he had taken medicinal cannabis for back pain.
Magistrate Virginia Sturgess adjourned the proceedings to Monday 24 October for the man to gather written medical proof of his medical condition from his general practitioner.
At 10.20 am on Thursday 11 August Warwick highway patrol intercepted another man on Wood St.
The P-plater was charged with driving with drugs present in his saliva after submitting to a test.
Magistrate Virginia Sturgess mentioned the man had been in this predicament before and she explained the drug is present for some time whether you feel affected by it or not.
The man pleaded guilty to the charge and was disqualified from driving for three months.
He was convicted and fined $350.
Possession of drugs and utensils
A man who recently moved to Warwick with a provisional licence came up against four charges related to possession of drugs, possession of utensils and driving under the influence of a drug.
On Saturday 9 July at 4 pm the man was pulled over in North Street Warwick and charged with drug driving after submitting to a test.
On 29 July at 7.30 pm he was charged on the Cunningham Highway, Amberley.
The prosecution said the arresting officers could smoke cannabis emanating from the vehicle which resulted in a search of the vehicle.
Officers found three grams of cannabis and a water pipe in the man’s possession.
Magistrate Virginia Sturgess said in relation to each of the charges of drug driving the mandatory minimum is three months.
“That means you have six months off the road.“
It wasn’t the man’s first time to front in court.
He was disqualified from driving for six months and was convicted and fined $600.
Menace and harassment
A man who used an electronic device to menace and harass was advised by Duty Lawyer Sarah Campbell to apply for Legal Aid.
However Magistrate Virginia Sturgess said in the history of the matter the man had already lodged with Legal Aid.
“He told me previously he lodged an application with Legal aid on the 27 June,“ Magistrate Sturgess said.
“On the 18 July the Legal Aid application was refused.“
The full brief was ordered on the day Legal Aid was refused.
The duty lawyer said the man has a session booked for in-house legal advice with Legal Aid.
Court was set in three weeks time, Monday 17 October.
